Ticket Terms and Conditions

  1. Introduction
    1. These are the Terms and Conditions of sale for tickets to attend virtually or in-person (each a “Ticket”) The New York Times Climate Hub (the “Event”). The Event is owned and organized by The New York Times Company (the “Organizer”).
    2. The Event is being held between 3 and 11 November 2021 in-person in Glasgow, Scotland, and online. There are different Ticket types as described on the Event website. Your Ticket will specify the session(s) and location(s) for your attendance at the Event.
    3. Your purchase of a Ticket will be subject to these Terms and Conditions and by purchasing a Ticket you agree to be bound by them. Please read these Terms and Conditions and pay particular attention to the Covid-19 measures and recording/​filming/​photography sections.
    4. You may purchase Tickets directly from the Organizer on its website, or from the Organizer’s third-party ticketing partner, TicketWeb. If you buy your Ticket from TicketWeb, you may also be subject to TicketWeb’s Terms and Conditions.
    5. You must be at least 16 years of age to attend the Event.
    6. You must provide proof of photo I.D. on arrival.
  2. Health and Safety — Covid-19 measures
    1. This section 2 applies only to Tickets bought for in-person sessions of the Event.
    2. For the safety of visitors and all on-site staff at the Event, you must provide the following on request upon entering the Event:
      1. proof of full vaccination — with the latest dose at least 14 days prior to the event. The Organizer will accept proof through the NHS App (England, Scotland, NI and Wales apps are all accepted), vaccination card, or letter provided by the NHS, or EU Digital Covid Certificate.
      2. if you are clinically exempt from Covid-19 vaccination, please bring proof of exemption.
  3. If you do not comply with the above Covid-19 measures, you may be refused entry to the Event and you will not receive a refund of your Ticket.
  4. Along with the date and time of your arrival and departure, the Organizer will collect the following personal data if applicable:
    1. your name; and
    2. contact telephone number.
  5. Under data protection law, GDPR Article 6(1), the Organizer has a number of lawful bases that allow us to collect and process personal information listed in section 2.4 above. In this case, the lawful basis for processing your data listed in section 2.4 above is "legitimate interests" under Article 6 and public health under Article 9. Broadly speaking "legitimate interests" means that the Organizer can process your personal information if the Organizer has a genuine and legitimate reason and is not harming any of your rights and interests. The Organizer’s legitimate reason for processing your data listed in section 2.4 above is to assist with NHS Scotland’s Test and Protect and other strategies in relation to the coronavirus public health epidemic.
  6. Before sharing any information listed in section 2.4 above, the Organizer will carefully consider and balance any potential impact on you and your rights. Your personal data listed in section 2.4 above will be retained only for the purposes stated above and will be held by us for no more than 3 weeks (21 days). All personal data listed in section 2.4 above will be held and disposed of in a safe and secure manner.
  7. Buying your Ticket
    1. A Ticket is required to enter, access and attend the Event. You will not be permitted entry without a valid Ticket.
    2. All Ticket prices are shown in GBP and are inclusive of VAT. Tickets may be ordered by clicking on the items you wish to purchase and then following the prompts that will appear on-screen. You may check and correct any input errors in your order up until the point at which you submit your order by tapping the “MAKE PAYMENT” button on the checkout page. The Organizer accepts all major credit and debit cards for payment.
    3. You may buy up to a maximum of 10 Tickets (the “Ticket Limit”). The Ticket Limit aims to discourage unfair ticket-buying practices. The Organizer reserves the right to cancel any or all ticket orders that exceed or circumvent the Ticket Limit. If you want to buy more than 10 Tickets, please contact us.
    4. Each in-person Ticket will be scanned and is only good for ONE single person. Each virtual Ticket permits ONE user to access the virtual Event.
    5. Re-entry to Event is only permitted if you have an in-person Ticket for The Forum, and Educate on Climate sessions and have purchased a one-day ticket or multi-day Ticket.
    6. Tickets are only valid for the date and session designated on your Ticket. Tickets will be issued electronically after purchase.
    7. Tickets may not be resold, exchanged or returned. To do so, or to alter or deface any ticket, will render it void.
    8. Tickets are nontransferable. Entry is based on the name(s) listed on the Ticket(s).
    9. Tickets are nonrefundable. Each Ticket is for a specific part or session of the Event, and cannot be exchanged for another part or session. It is your responsibility to check your Ticket, as mistakes cannot always be rectified. The Organizer shall not be responsible for any lost or stolen Tickets. By submitting an order for a Ticket, you acknowledge and accept that all details provided are correct and consent to the Organizer providing e-tickets immediately following processing of payment.
    10. Tickets shall not be used as prizes in competitions or as free "giveaways" without the prior written consent of the Organizer.
  8. Event information
    1. The Event shall be held rain or shine. Should an Act of God or other event outside the Organizer’s control mean the Event cannot go ahead, you will be issued a refund for your Ticket.
    2. Tickets are sold subject to the Organizer’s absolute right to alter or vary the Event without any obligation to make a refund. If the Event is canceled in its entirety prior to its commencement then you will be entitled to a refund of the Ticket price but no refund will be given in respect of any other expenditure whatsoever. Details of how to claim refunds, exchanges or future discounts will be provided by the Organizer on the Event day and/or on the Event website.
    3. You voluntarily assume all risk and danger incidental to the Event, whether occurring prior to, during or after the Event. You voluntarily agree that the facility, sponsors, participants, the Organizer and all of their respective agents, officers, directors, owners, affiliates, employees and consultants are expressly released by you from any claims arising from such causes. Your statutory rights as consumers in connection with your purchase of Tickets are not affected by these Terms and Conditions. Nothing in these Terms and Conditions limits the Organizer’s liability for death or personal injury caused by its negligence, or fraud or fraudulent misrepresentation.
    4. If you arrive late for a session included in your Ticket, you may not be admitted until a suitable break. Certain sessions may not admit latecomers at all. In the event that it is not possible to admit a latecomer for any reason, no refunds will be offered.
    5. If you wish to consume alcohol at the Event, you must be at least 18 years old and show a valid government-issued ID on request. You are not permitted to bring your own alcohol into the in-person Event and you may be asked to leave if you do so.
  9. Recording/​filming/​photography at the Event
    1. Unless otherwise agreed in writing with the Organizer, any material filmed or recorded by you at the Event may only be used for your personal, noncommercial, nonprofit-making enjoyment.
    2. The Event and its attendees (including online attendees) will be photographed, filmed and/or recorded by the Organizer and other media outlets and the recordings (“Recordings”) may be broadcast on television, published (including on the internet) and otherwise publicized by the Organizer, its affiliates, licensees, partners and other media outlets (“Organizer Parties”).
    3. You may feature in such Recordings as part of the audience/attendees. By buying a Ticket to attend the Event (whether physically or online), you are granting your permission to the Organizer Parties to record you for commercial purposes and agree to the following:
      1. being filmed, videotaped, photographed and/or recorded by any means;
      2. full use of your name, likeness, voice and words (including biographical information and opinions) by the Organizer Parties, without compensation in any media, edited in any manner, and in combination with any other content and for any purpose; and
      3. releasing the Organizer Parties from liability for loss, damage or compensation for the use of your name, likeness, voice and words.
    4. To the extent that you own any copyright, performers’ rights or similar rights in any Recordings, you hereby grant the Organizer Parties a worldwide, royalty-free, perpetual, irrevocable, transferable and sub-licensable licence to use such Recordings in any media, edited in any manner, and in combination with any other content, in accordance with the other provisions of these Terms and Conditions. To the extent permissible by law, you waive any moral rights you may have in the Recordings.
    5. By attending the Event, you acknowledge and agree that:
      1. Organizer and the other Organizer Parties are media organizations and a fundamental part of their operations is providing, communicating and making available content to the public;
      2. The subject matter of the Event is climate change, which is a matter of substantial public interest and/or for the education and/or knowledge of the general public;
      3. Organizer’s and the other Organizer Parties’ operations, including in connection with the Event, involve freedom of expression and information, including journalistic, academic, and/or literary expression and purposes, and/or commercial, promotional and/or advertising purposes;
      4. Freedom of expression and information includes without limitation processing your personal information as described herein in any country (including via the internet). Any personal information, including any image and voice Recordings made in the context of the Event and any biographical information, opinions or other statements about or made available by you during the Event may be used for journalistic, academic and/or literary purposes and its processing is subject to the laws governing such uses;
      5. Organizer’s and other Organizer Parties’ freedom of expression in connection with the Event includes retaining records and archives of Recordings made at the Event and continuing to disseminate, promote and/or make all or parts of them available to the public;
      6. There is a special importance in freedom of expression and of information (including without limitation journalistic, academic and/or literary expression, education and information) itself, which is in the public interest;
      7. Organizer and other Organizer Parties rely on releases (including under these Terms and Conditions) and third-party content (including the Recordings) as part of its operations, including to produce, promote and disseminate the Event; and
      8. Organizer and other Organizer Parties will process your personal information in relation to the activities contemplated by these Terms and Conditions, the legal basis of which is their legitimate interests in using Recordings. You have read and understood the Organizer’s privacy policy.
  10. Your behavior at the Event
    1. For the safety, enjoyment and security of all attendees of the Event, you must comply with the following rules while attending any session of the Event:
      1. In respect of any in-person sessions, you must, if requested by Organizer staff, security personnel or venue staff, allow a search of your bag, and consent to nonintrusive pat-down searches and/or scans;
      2. You acknowledge that any offensive, illegal or dangerous materials found on you or in or with your belongings may be removed and not returned to you;
      3. You must treat all speakers (including moderators, guests, lecturers), Organizer staff, venue staff, security personnel, other attendees and media personnel respectfully and not harass any person;
      4. You must not be violent, intoxicated, overly aggressive or engage in political campaigning;
      5. You must comply with any directions given to you (whether in writing or verbally) by any Organizer staff or venue staff (including but not limited to, not filming or recording at certain times or not speaking over other people); and
      6. You must comply with all applicable laws and government guidelines.
    2. If you do not comply with any of the Event rules as set out in this section, the Organizer may:
      1. Require that you leave the Event and not return;
      2. Refuse to refund the purchase price of your Ticket; and/or
      3. Where appropriate, refer you to the relevant law enforcement authorities.
  11. General provisions:
    1. These Terms and Conditions shall be governed by English law, and you agree that any dispute between you and the Organizer regarding them or the Event will only be dealt with by the English courts, provided that, if you are a consumer and not a business user and you live in a part of the United Kingdom other than England, the applicable law of that part of the United Kingdom will govern and any dispute will only be dealt with by the courts there.
    2. All notices given by you to us must be given in writing to the address set out at the start of these Terms and Conditions. The Organizer may give notice to you at either the email or postal address you provide to us when placing an order.
    3. If the Organizer fails to enforce any of its rights, that does not result in a waiver of that right.
    4. If any provision of these terms and conditions is found to be unenforceable, all other provisions shall remain unaffected.
    5. These terms and conditions may not be varied except with the Organizer’s express written consent.
    6. For information on how NYT collects, uses and shares any personal information, you are invited to review our Privacy Policy. If you reside outside of the European Economic Area, your acceptance of these Terms and Conditions constitutes your acknowledgment of the processing activities described in our Privacy Policy under the laws of your jurisdiction.
